These notices shall satisfy two separate but related procedural requirements

for activities to be undertaken by Atascosa County

REQUEST FOR RELEASE OF FUNDS

On or about 05/20/2025, Atascosa County will submit a request to the Texas Department of Agriculture (Department), Office of Rural Affairs for the release of 2024 Community Development Block Grant funds under Section 104(f) of Title I of the Housing and Community Development Act of 1974 as amended, to undertake a project known as 2024 TDA CDBG Atascosa County Water Improvements #CDV23-0227 for the purpose of adding another water source. 

Project Description: In cooperation with El Oso Water Supply Corporation, construct one (1) ground storage tank, one (1) cooling tower with a platform, two (2) filter pumps, two (2) filter backwash pumps, yard piping, electrical improvements, and all necessary appurtenances, to include administrative and engineering services and fees.

Funding: Estimated Total HUD CDBG Funded Amount:   $500,000.00.

Estimated Non-HUD Funds: El Oso Water Supply Corporation: $10,000.00. 

Total Estimated Project Cost (HUD and non-HUD Funds): $510,000.00. 

FINDING OF NO SIGNIFICANT IMPACT

Atascosa County has determined that the project will have no significant impact on the human environment; therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR). The ERR will be made available to the public for review electronically or by U.S. mail. Please submit your request by U.S. mail to the County at the address above or by email to countyjudge@atascosacounty.texas.gov

                                                          PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the County. All comments received by 05/19/2025 will be considered by the County prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION

The County certifies to the Texas Department of Agriculture (TDA), Office of Rural Affairs that Weldon Cude, in his capacity as County Judge consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Department’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Atascosa County to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

The Texas Department of Agriculture will accept objections to its release of funds and the County’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request, (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Atascosa County (b) Atascosa County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Department; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Environmental Review Specialist, Texas Department of Agriculture by email at CDBG_ENVReview@TexasAgriculture.gov. Potential objectors should contact the TDA Environmental Review Specialist at CDBG_ENVReview@TexasAgriculture.gov to verify the actual last day of the objection period.

AVISO DE INTENCIÓN DE SOLICITAR LA LIBERACIÓN DE FONDOS

Estos avisos cumplen con dos requisitos procesales separados pero relacionados para actividades que serán emprendidas por el Condado de Atascosa.

SOLICITUD DE LIBERACIÓN DE FONDOS
 A partir del 20/05/2025, el Condado de Atascosa enviará una solicitud al Departamento de Agricultura de Texas (Departamento), Oficina de Asuntos Rurales, para la liberación de fondos de la Subvención para el Desarrollo Comunitario de 2024 bajo la Sección 104(f) del Título I de la Ley de Vivienda y Desarrollo Comunitario de 1974, con sus enmiendas, para llevar a cabo un proyecto conocido como 2024 TDA CDBG Mejora del Agua en el Condado de Atascosa #CDV23-0227 con el propósito de agregar una fuente adicional de agua.

Descripción del proyecto: En cooperación con la Corporación de Suministro de Agua El Oso, se construirá un (1) tanque de almacenamiento subterráneo, una (1) torre de enfriamiento con una plataforma, dos (2) bombas de filtro, dos (2) bombas de retro-lavado de filtro, tuberías exteriores, mejoras eléctricas y todos los accesorios necesarios, incluidos los servicios y honorarios administrativos y de ingeniería.

 Monto total estimado financiado por HUD CDBG: $500,000.00.

DETERMINACIÓN DE NINGÚN IMPACTO SIGNIFICATIVO
 El Condado de Atascosa ha determinado que el proyecto no tendrá un impacto significativo en el entorno humano; por lo tanto, no se requiere una Declaración de Impacto Ambiental bajo la Ley de Política Ambiental Nacional de 1969 (NEPA). La información adicional del proyecto está contenida en el Registro de Revisión Ambiental (ERR). El ERR estará disponible para el público para su revisión electrónicamente o por correo postal. COMENTARIOS PÚBLICOS
 Cualquier individuo, grupo o agencia puede enviar comentarios escritos sobre el ERR al Condado. CERTIFICACIÓN AMBIENTAL
 El Condado certifica ante el Departamento de Agricultura de Texas (TDA), Oficina de Asuntos Rurales, que Weldon Cude, en su calidad de Juez del Condado, consiente aceptar la jurisdicción de los Tribunales Federales si se presenta una acción para hacer cumplir las responsabilidades relacionadas con el proceso de revisión ambiental y que estas responsabilidades han sido satisfechas. La aprobación de la certificación por parte del Departamento satisface sus responsabilidades bajo NEPA y las leyes y autoridades relacionadas y permite al Condado de Atascosa utilizar fondos del Programa.

OBJECIONES A LA LIBERACIÓN DE FONDOS
 El Departamento de Agricultura de Texas aceptará objeciones a su liberación de fondos y a la certificación del Condado durante un período de quince días después de la fecha anticipada de presentación o su recepción real de la solicitud (lo que ocurra más tarde), solo si se basan en alguna de las siguientes razones: (a) la certificación no fue firmada por el Oficial Certificador del Condado de Atascosa; (b) el Condado de Atascosa omitió un paso o no tomó una decisión o hallazgo requerido por las regulaciones de HUD en 24 CFR Parte 58; (c) el beneficiario de la subvención u otros participantes en el proceso de desarrollo han comprometido fondos, incurrido en costos o realizado actividades no autorizadas por 24 CFR Parte 58 antes de la aprobación de la liberación de fondos por parte del Departamento; o (d) otra agencia federal actuando de acuerdo con 40 CFR Parte 1504 ha presentado un hallazgo por escrito de que el proyecto es insatisfactorio desde el punto de vista de la calidad ambiental. Las objeciones deben prepararse y enviarse de acuerdo con los procedimientos requeridos (24 CFR Parte 58, Sec. 58.76) y deben enviarse al Especialista en Revisión Ambiental, Departamento de Agricultura de Texas, por correo electrónico a CDBG_ENVReview@TexasAgriculture.gov. Los posibles objetores deben contactar al Especialista en Revisión Ambiental de TDA en CDBG_ENVReview@TexasAgriculture.gov para verificar el último día real del período de objeción.
