These notices shall satisfy two separate but related procedural requirements

for activities to be undertaken by the City of Rockdale

REQUEST FOR RELEASE OF FUNDS

On or about 06/13/25, the City of Rockdale (City) will submit a request to the Texas Department of Agriculture (Department), Office of Rural Affairs for the release of 2024 Community Development Block Grant funds under Section 104(f) of Title I of the Housing and Community Development Act of 1974 as amended, to undertake a project known as 2024 CDBG City of Rockdale NE Sewer Improvements Project #CDV23-0449 for the purpose of replacing an undersized lift station. Project Description: Replace existing lift station including demolition of existing facilities: install one (1) submersible pump station and one (1) FRP valve vault and electrical components, install approximately fifty linear feet (50 LF) of eighteen-inch (18 in.) sewer line, and 45 linear feet (45 LF) of four-inch (4 in.) force main, seventy linear feet (70 LF) of security fence, all necessary appurtenances, and administration and engineering services and fees, at the following location: East Cameron Lift Station, south of E. Cameron Avenue behind Pecan Grove RV Park, (30.66263, -96.98323), Rockdale, Milam County, TX.

Funding: CDBG $500,000; Rockdale Municipal Development District matching funds $50,000. Total Estimated Project Cost: $550,000. 

FINDING OF NO SIGNIFICANT IMPACT

The City has determined that the project will have no significant impact on the human environment; therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR). The ERR will be made available to the public for review electronically or by U.S. mail. Please submit your request by U.S. mail to the City at the address above or by email to sjohnson@rockdaletx.gov.

                                                          PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the City. All comments received by 06/09/25 will be considered by the City prior to authorizing submission of a request for release of funds.  Comments can be mailed to the City of Rockdale at P. O. Box 586, Rockdale, Milam County, TX , 76567-0586, Attn: Mayor’s Office, or by email to sjohnson@rockdaletx.gov.  (512) 446-2511.  Comments should specify which Notice they are addressing.  

ENVIRONMENTAL CERTIFICATION

The City certifies to the Texas Department of Agriculture (TDA), Office of Rural Affairs that Tim Kelty, in his capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Department’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Rockdale to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

The Texas Department of Agriculture will accept objections to its release of funds and the City’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request, (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of The City of Rockdale (b) the City of Rockdale has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Department; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Environmental Review Specialist, Texas Department of Agriculture by email at CDBG_ENVReview@TexasAgriculture.gov. Potential objectors should contact the TDA Environmental Review Specialist at CDBG_ENVReview@TexasAgriculture.gov to verify the actual last day of the objection period.

AVISO DE INTENCIÓN DE SOLICITAR LA LIBERACIÓN DE FONDOS

Estos avisos satisfacen dos requisitos procedimentales separados pero relacionados para actividades que serán emprendidas por la Ciudad de Rockdale.

SOLICITUD DE LIBERACIÓN DE FONDOS

 A partir del 13/06/2025, la Ciudad de Rockdale (Ciudad) presentará una solicitud al Departamento de Agricultura de Texas (Departamento), Oficina de Asuntos Rurales, para la liberación de fondos del Programa de Subvenciones para el Desarrollo Comunitario (CDBG, por sus siglas en inglés) de 2024 bajo la Sección 104(f) del Título I de la Ley de Vivienda y Desarrollo Comunitario de 1974, según enmienda, para llevar a cabo un proyecto conocido como Proyecto de Mejoras al Alcantarillado del Noreste de la Ciudad de Rockdale 2024 CDBG #CDV23-0449 con el propósito de reemplazar una estación de bombeo subdimensionada.
Descripción del Proyecto: Reemplazo de la estación de bombeo existente, incluyendo la demolición de las instalaciones existentes; instalación de una (1) estación de bombeo sumergible y un (1) pozo de válvulas FRP y componentes eléctricos, instalación de aproximadamente cincuenta pies lineales (50 LF) de tubería de alcantarillado de 18 pulgadas (18 in.), y 45 pies lineales (45 LF) de tubería de presión de 4 pulgadas (4 in.), setenta pies lineales (70 LF) de cerca de seguridad, todos los accesorios necesarios, y los servicios de administración e ingeniería, en la siguiente ubicación: Estación de Bombeo East Cameron, al sur de la Avenida E. Cameron, detrás del Pecan Grove RV Park, (30.66263, -96.98323), Rockdale, Condado de Milam, TX. Financiamiento: CDBG $500,000; fondos de contrapartida del Distrito de Desarrollo Municipal de Rockdale $50,000. Costo Total Estimado del Proyecto: $550,000.

DETERMINACIÓN DE NO IMPACTO SIGNIFICATIVO

 La Ciudad ha determinado que el proyecto no tendrá un impacto significativo sobre el entorno humano; por lo tanto, no se requiere una Declaración de Impacto Ambiental bajo la Ley Nacional de Política Ambiental de 1969 (NEPA, por sus siglas en inglés). La información adicional del proyecto está contenida en el Registro de Revisión Ambiental (ERR, por sus siglas en inglés). El ERR estará disponible al público para su revisión electrónicamente o por correo postal. Por favor, envíe su solicitud por correo postal a la Ciudad a la dirección indicada arriba o por correo electrónico a sjohnson@rockdaletx.gov.

COMENTARIOS PÚBLICOS

 Cualquier individuo, grupo u organismo puede presentar comentarios por escrito sobre el ERR a la Ciudad. Todos los comentarios recibidos antes del 09/06/25 serán considerados por la Ciudad antes de autorizar la presentación de la solicitud de liberación de fondos. Los comentarios pueden enviarse por correo a la Ciudad de Rockdale a P. O. Box 586, Rockdale, Condado de Milam, TX, 76567-0586, Atención: Oficina del Alcalde, o por correo electrónico a sjohnson@rockdaletx.gov. (512) 446-2511. Los comentarios deben especificar a qué Aviso se están refiriendo.

CERTIFICACIÓN AMBIENTAL

 La Ciudad certifica al Departamento de Agricultura de Texas (TDA), Oficina de Asuntos Rurales, que Tim Kelty, en su calidad de Gerente de la Ciudad, consiente en aceptar la jurisdicción de los Tribunales Federales si se presenta una acción para hacer cumplir las responsabilidades relacionadas con el proceso de revisión ambiental y que estas responsabilidades han sido satisfechas. La aprobación de la certificación por parte del Departamento satisface sus responsabilidades bajo la NEPA y leyes y autoridades relacionadas, y permite que la Ciudad de Rockdale utilice los fondos del Programa.

OBJECIONES A LA LIBERACIÓN DE FONDOS

El Departamento de Agricultura de Texas aceptará objeciones a la liberación de fondos y la certificación de la Ciudad durante un período de quince días después de la fecha anticipada de presentación o de su recepción real de la solicitud (lo que ocurra más tarde), solo si se basan en una de las siguientes razones: (a) la certificación no fue firmada por el Oficial Certificador de la Ciudad de Rockdale; (b) la Ciudad de Rockdale omitió un paso o no tomó una decisión o hallazgo requerido por las regulaciones de HUD en 24 CFR Parte 58; (c) el beneficiario de la subvención o los demás participantes en el proceso de desarrollo han comprometido fondos, incurrido en costos o emprendido actividades no autorizadas por 24 CFR Parte 58 antes de la aprobación de la liberación de fondos por parte del Departamento; o (d) otra agencia federal actuando conforme a 40 CFR Parte 1504 ha presentado un hallazgo escrito de que el proyecto es insatisfactorio desde el punto de vista de la calidad ambiental. Las objeciones deben prepararse y enviarse de acuerdo con los procedimientos requeridos (24 CFR Parte 58, Sec. 58.76) y deben ser dirigidas al Especialista en Revisión Ambiental, Departamento de Agricultura de Texas, por correo electrónico a CDBG_ENVReview@TexasAgriculture.gov. Los posibles objetores deben ponerse en contacto con el Especialista en Revisión Ambiental de la TDA a CDBG_ENVReview@TexasAgriculture.gov para verificar el último día real del período de objeciones.
